Terms of Service

Introduction

Please read these Terms of Service ("Terms") carefully before using the JustVM website at https://justvm.com, the JustVM web app, and the JustVM voicemail service (together, the "Service"). The Service is operated by SendHawk, LLC, a limited liability company formed in North Carolina, United States ("us", "we", "our"). These Terms contain important information about limitations of our liability.

Your access to and use of the Service is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone who wishes to access or use the Service, including visitors, subscribers, and others.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have our permission to access or use the Service. Our Privacy Policy explains how we handle personal information.

The Service

JustVM is a personal voicemail service. As a subscriber, you get a JustVM phone number, which you typically set as your mobile carrier's conditional call-forwarding number. When someone calls, the caller hears your greeting and may leave a message. We record and store the message, transcribe it, translate it into English if it is in another language, and notify you by email and, if you choose, by push notification. You manage your messages in the JustVM web app, which can also be installed on your device.

Setting up call forwarding with your carrier is your responsibility. Your carrier may charge for forwarded calls, and we are not responsible for your carrier's service, settings, or fees.

Invite-only beta

JustVM is currently an invite-only beta. Accounts are created by invitation. Joining the waitlist does not guarantee an invitation.

Because the Service is in beta, features may change, be added, or be removed, and the Service may be interrupted. We may change, suspend, or discontinue all or part of the Service at any time. If we discontinue the Service, we will try to give subscribers reasonable notice so they can download any messages they want to keep.

Our offers and pricing

The Service is currently free during the invite-only period.

If we introduce fees, we will tell you the price and terms before you are charged, and you will not be charged unless you agree. Prices do not include taxes or other fees that you may be charged.

Purchases and subscriptions

If we offer paid plans in the future, payments will be handled by a third-party payment processor, which will collect and process your payment information. We are not responsible for the collection, use, sharing, or security of your billing information by that processor.

You represent and warrant that you have the legal right to use any payment method you provide and that the information you supply to us and to the payment processor is true, correct, and complete.

Any subscription terms, including billing period, automatic renewal, how to cancel, and our cancellation and refund policies, will be shown to you before you purchase.

Accounts

When you create or accept an account for the Service, you guarantee that you are 18 years of age or older and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account.

You are responsible for maintaining the confidentiality of your account and password, including restricting access to your devices and account. You accept responsibility for all activities that occur under your account, whether your password is with us or with a third-party sign-in service. You must notify us immediately at support@justvm.com if you become aware of any breach of security or unauthorized use of your account.

We reserve the right to terminate your account at any time at our sole discretion. You can end your account at any time by contacting us. When an account is deleted, its messages, recordings, greeting, and settings are deleted as described in our Privacy Policy.

Phone numbers

Your JustVM phone number is provided through our telephony provider. You do not own the number. It is assigned to you for use with the Service while your account is active.

We may not be able to port your JustVM number to another provider, and we do not promise that porting will be available. If your account ends, the number may be released and later assigned to someone else. We may change your number if our telephony provider requires it or if it is needed to keep the Service running, and we will tell you if we do.

Your greeting and messages

You are responsible for your greeting, whether you record it, upload it, or generate it from text. Your greeting must not be unlawful, deceptive, harassing, or infringe anyone's rights, and it must not impersonate another person or organization.

You keep whatever rights you have in your greeting and in the messages left for you. You grant SendHawk, LLC a limited, non-exclusive, royalty-free license to store, copy, process, transcribe, translate, classify, and transmit that content only as needed to provide the Service to you and as described in our Privacy Policy. This license ends when the content is deleted, except for copies that remain in backups for a limited time.

We do not publish your greeting or your messages. We reserve the right to remove or disable a greeting that violates these Terms.

Call recording and your legal responsibilities

The Service records messages that callers choose to leave for you. Laws about recording calls vary by state and country, and some require the consent of everyone on the call.

You are solely responsible for complying with all call-recording, privacy, and consent laws that apply to you and to the people who call you. This includes giving any recording notice the law requires, for example in your greeting. You agree to use recordings and transcripts only for lawful purposes.

No emergency calls

JustVM is not a telephone service. It cannot place or receive calls to 911 or any other emergency service.

Voicemail delivery depends on your carrier, our telephony provider, and other services outside our control. Messages and notifications can be delayed, fail to arrive, or be lost. Do not rely on JustVM for urgent, time-sensitive, or emergency matters.

Automated transcription, translation, and spam filtering

Transcripts, translations, caller ID names, and spam and hang-up classification are produced automatically, including by third-party AI models, and may be incomplete or inaccurate. Always listen to the recording if the details matter.

The Service may file a real message in your Spam/Hang-up folder by mistake. Messages in that folder are deleted automatically, along with their audio, after 30 days. If you want to keep a message, move it back to your inbox before then. We are not responsible for messages that are misfiled or automatically deleted.

Prohibited uses

You agree that you will use the Service in accordance with all applicable laws, rules, regulations, and these Terms at all times. The following is a non-exhaustive list of prohibited uses. You agree that you will not:

• Use the Service for illegal robocalling, telemarketing, or any unsolicited calling or messaging campaign;
• Use the Service to harass, threaten, stalk, or intimidate anyone;
• Record, store, or use calls in violation of any law;
• Use a greeting or the Service to deceive callers, including by impersonating another person, business, or government agency;
• Impersonate or attempt to impersonate SendHawk, LLC or its employees, representatives, subsidiaries, or divisions;
• Misrepresent your identity or affiliation with any person or entity;
• Send or attempt to send any advertising or promotional material, including spam, junk mail, chain mail, or similar material;
• Engage in any conduct that restricts or inhibits anyone's use of the Service, or which, as determined in our sole discretion, may harm us or users of the Service or expose us or others to liability;
• Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with another party's use of it;
• Use any robot, spider, or other automated means to access or use the Service for any purpose, including monitoring or copying any of its material, except through features we provide;
• Use any device, software, or routine that interferes with the proper working of the Service, including viruses, trojan horses, worms, logic bombs, or similar materials;
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Service, the servers on which it runs, or any server, computer, or database connected to it;
• Attack or attempt to attack the Service with a denial-of-service or distributed denial-of-service attack;
• Resell or sublicense the Service or your JustVM number without our written permission;
• Otherwise attempt to interfere with the proper working of the Service; or
• Use the Service in any way that violates any applicable federal, state, or local law, rule, or regulation.

We may suspend or terminate your account if we believe you have violated this section.

No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". NO WARRANTY, EXPRESS OR IMPLIED (INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE OR USE) SHALL APPLY TO THE SERVICE, WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY MESSAGE WILL BE RECORDED OR DELIVERED, OR THAT ANY TRANSCRIPT, TRANSLATION, OR CLASSIFICATION WILL BE ACCURATE.

Availability, errors and inaccuracies

We assume no liability for the availability, errors, or inaccuracies of the information or services provided through the Service. The Service may contain errors or inaccuracies or may not be complete or current. We rely on third-party providers for telephony, hosting, email, transcription, translation, and notifications, and their outages or errors may affect the Service.

Damages and limitation of liability

IN NO EVENT SHALL SENDHAWK, LLC BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF, RELATING TO, OR IN ANY WAY CONNECTED WITH YOUR ACCESS TO OR USE OF THE SERVICE, OR WITH THE DELAY OR INABILITY TO ACCESS OR USE THE SERVICE, INCLUDING BUT NOT LIMITED TO MISSED, DELAYED, LOST, MISFILED, OR DELETED MESSAGES; INACCURATE TRANSCRIPTS, TRANSLATIONS, OR CLASSIFICATIONS; YOUR RELIANCE UPON INFORMATION PROVIDED THROUGH THE SERVICE; OR ANY COMPUTER VIRUSES, INFORMATION, SOFTWARE, LINKED WEBSITES OPERATED BY THIRD PARTIES, PRODUCTS, OR SERVICES OBTAINED THROUGH THE SERVICE, WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, STRICT LIABILITY, CONSUMER PROTECTION STATUTES, OR OTHERWISE, EVEN IF SENDHAWK, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE AGGREGATE LIABILITY OF SENDHAWK, LLC ARISING OUT OF OR RELATING TO THE SERVICE, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, SHALL BE LIMITED TO THE AMOUNT OF FEES ACTUALLY RECEIVED BY SENDHAWK, LLC FROM YOU.

THIS LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN YOU AND US. THE LIMITATIONS IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. THE LIMITATIONS OF LIABILITY PROVIDED IN THESE TERMS INURE TO THE BENEFIT OF SENDHAWK, LLC.

Indemnification

You agree to indemnify and hold harmless SendHawk, LLC from any claims, damages, and expenses (including reasonable attorneys' fees) arising from your greeting, your use of recordings or transcripts, your violation of any call-recording or other law, or your violation of these Terms.

Links to third party websites

The Service may contain links to websites operated by third parties and not by us. We provide these links for your reference only. We do not control those websites and are not responsible for their contents or their privacy or other practices. It is your responsibility to take precautions to ensure that whatever links you click or software you download, whether from the Service or elsewhere, is free of viruses, worms, trojan horses, defects, and other items of a destructive nature. Including a link does not imply that we endorse the material on that website or have any association with its operators.

Intellectual property and DMCA notice

All contents of the Service are © 2026 SendHawk, LLC or third parties. All rights reserved. Unless specified otherwise, the Service and all of its content and materials, including logos, designs, text, graphics, pictures, information, data, software, sound files, and their arrangement (collectively, "Content"), are the proprietary property of SendHawk, LLC and are trademarks or otherwise protected intellectual property of SendHawk, LLC or third parties in the United States and/or other countries. Your greeting and the messages left for you are not our Content; see Your greeting and messages.

We respect the intellectual property rights of others. If you believe in good faith that material available through the Service infringes your intellectual property rights, you or your agent may send us a written notice titled "Infringement of Intellectual Property Rights - DMCA." Your notice must include:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property right;
• A description of the work that you claim has been infringed, and where the infringing material is located on the Service;
• Your name, email, address, and telephone number; and
• A statement by you that you have a good faith belief that the disputed use is not authorized by the owner of the work, its agent, or the law.

We will not process your complaint if it is not properly filled out or is incomplete. You may be held accountable for damages, including costs and attorneys' fees, for any misrepresentation or bad faith claim of infringement.

Governing law, severability, dispute resolution, venue and class action waiver

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of laws provisions. THESE TERMS SHALL NOT BE GOVERNED BY THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE SALE OF INTERNATIONAL GOODS, THE UNIFORM COMMERCIAL CODE, NOR INCOTERMS.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service, and supersede and replace any prior agreements we might have had with you regarding the Service.

Any controversy or claim arising out of or relating to these Terms, including their interpretation or breach, shall be resolved in a court of competent jurisdiction in Wake County, North Carolina.

YOU AND SENDHAWK, LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

Changes to these Terms

We reserve the right to make changes to these Terms at any time. We will notify you of any changes by posting the updated Terms on this website and updating the "Last updated" date above. If we make material changes, we will also try to tell subscribers by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
